These Terms apply to any new features that Powerup may offer. Your continued use of Powerup following any updates or changes to the Terms will be interpreted as your acceptance of those changes.
Definitions
A TAF is a program or tool made to assist with effective project management, planning, and organisation. It makes it possible for groups to work together, monitor development, distribute resources, and successfully fulfil deadlines. Features including task management, time tracking, document sharing, reporting, and communication capabilities are frequently included in PMS platforms. By guaranteeing accountability, optimising workflows, and enhancing project execution overall, these solutions increase productivity.
In these Terms the definitions listed below shall have the following meanings:
“Website” means our websites located at TAF.COM, including all subpages;
“Service” means our TAF, our content and various third-party services;
“TAF” means our Websites and Services collectively;
“you” or “your” means the person or entity that’s registered with us and uses TAF;
“Terms” means our Terms of Service, which includes our Privacy Policy and Cookie Policy;
General rules
To use TAF, you shall
be at least 16 years old if you live in the EU, 13 if you live outside of it, or under 13 (or 16 if applicable), and you must attest that your parent or legal guardian has read these terms and has given you permission to use Powerup in accordance with them. At any point, we could need sufficient documentation of your identity, age, and parental or legal guardian agreement;
complete the registration process;
provide current and accurate information;
agree to these Terms; and
promise to abide by the conditions set forth in these Terms.
Right to use

Try to interfere with the operation of Powerup, disrupt the process of providing Powerup to other users or otherwise try to harm Powerup and / or its users (DoS, DDoS attack, etc.);
To request the performance of any action that violates our rights or the rights of others, use TAF. Any customer, employee, or officer who engages in verbal, physical, written, or other abuse—including threats of abuse or retaliation—will have their account immediately terminated;
Use TAF to upload, transmit, or otherwise distribute any objectionable content, as solely determined by us;
Utilise data that is subject to personal data laws (such as the CCPA and GDPR) in a way that is against the law;
Any other use of TAF that violates these Terms or the applicable legislation is prohibited.
Your right to use TAF may be terminated without a refund if you violate any of the aforementioned conditions or any other portion of the Terms. Legal repercussions could potentially result from your activities.
Intellectual Property
TAF Ownership: Except as specifically provided to you herein, we own Time Tracking and all rights to TAF (including all additions and modifications to Powerup, in any version), its parts and components, and other intellectual property. Without our express written consent, you are not permitted to duplicate, reproduce, change, modify, resell, mirror, or generate derivative works of TAF.
Ownership of a trademark: We own, register, and/or license all trade names, trademarks, and service marks. By using TAF, you do not obtain a license or any ownership rights to any trade names, service marks, or trademarks.
Term
Your permission to use TAF is effective as soon as you accept these terms, and it will continue to be in full force and effect until it is terminated as explained below.
Termination.
We reserve the right, at our sole discretion and pursuant to the applicable laws, to keep or remove the data you gave us when using a paid membership in the event that it is cancelled or terminated. Any termination, including the removal of your content, will not subject you to any liability on our part.
If we have reasonable grounds to believe that you are in breach of these Terms or applicable laws;

If you want to completely delete your account and your data please contact us.
Effect of termination: Upon termination, you shall stop using TAF. Termination for any reason does not bind us to return you any fees. Your obligations to pay off the outstanding payments to us, if any, shall remain in force after termination until their full performance.
Indemnification
You agree to indemnify and hold harmless us and our authorized officers, directors, employees, agents, partners, licensors, resellers, successors, and assigns against any third-party claim arising from or in any way related to your breach of these Terms or your use of Powerup in violation of applicable laws, rules or regulations, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys’ fees of any kind and nature.
Representations and Warranties
No advice or information, whether oral or written, obtained from us or elsewhere, shall create any warranty not expressly stated in these Terms. You are solely responsible for any consequences of your use of TAF.
To the greatest degree allowed by law, we offer TAF "as is" and "as available," meaning that we make no explicit or implicit guarantees of any kind, including merchantability and fitness for a particular purpose, as well as any warranties that:
TAF will meet your specific requirements;
TAF will be available in uninterrupted, timely, secure, or error-free basis;
The results that may be obtained from the use of TAF will be accurate or reliable;
The quality of any products, services, information, or other material purchased or obtained by you through TAF will meet your expectations;
Any errors in TAF will be corrected
Limitation of Liability
You hereby acknowledge and agree that we will not be held responsible for any direct, indirect, incidental, special consequential, exemplary, incidental, or punitive damages, including lost profits, even if we were aware that you might suffer such damages. These damages could include any loss of profit (direct or indirect), any business reputation or goodwill loss, any data loss, the cost of acquiring replacement services, or other losses. Regardless of whether we were informed of or should have known that such losses might occur, the aforementioned restrictions on our liability will nonetheless be in effect.
Regarding your use of TAF and any associated websites and services, we disclaim all responsibility for the actions, inactions, and behaviour of any third parties. If you are unhappy with TAF's service, your only recourse is to discontinue using it. A key component of our agreement is the restriction of damages. Any damages, responsibility, or injuries resulting from carelessness, a breach of contract, a tort, or any other line of action are covered by the aforementioned disclaimer.
Cap on liability: In spite of the other clauses in the Terms, we may be held accountable to you for any loss or damage resulting from or related to your use of TAF.
You acknowledge that we will never be held accountable for any failure or delay that results from events beyond our reasonable control, such as natural disasters, floods, fires, earthquakes, explosions, war, terrorism, invasions, riots or other civil unrest, embargoes or blockades, a national or regional emergency, deterioration of internet connections, strikes, labour slowdowns or stoppages, or other industrial disruptions; a law being passed; any action by a governmental or public authority, such as imposing an embargo, a restriction on imports or exports, a quota, or any other restriction or prohibition; or any full or partial government shutdown; or a lack of sufficient power, telecommunications (including a deteriorating internet connection), or transportation on a national or regional level.
Severability
If any part of these terms is determined to be invalid or unenforceable for any reason, the remaining parts of these terms will remain intact, and the invalid or unenforceable part will be deemed changed to the greatest degree allowed by law.
Assignments
None of your rights or responsibilities under these terms may be transferred to another person. Any assignment attempt that violates the aforementioned rules will be deemed invalid. Without your permission, we reserve the right to transfer our rights to any other person or organisation at our sole discretion. Assignees will be bound by the terms of these terms.
No Waiver
Any right or term of these Terms that we are unable to execute or enforce will not be deemed waived.
Entirety of Agreement
Any previous discussions and agreements between you and us (including any previous versions of the Terms) are superseded by these Terms and all documents incorporated into these Terms by reference, which constitute the final, complete, and exclusive agreement between you and us with regard to the subject matters and govern your use of TAF.
Amendments and Changes to Taf
The Terms may be changed, modified, added, or removed at any time, with or without notice, at our sole discretion. Any modifications to these terms will take effect as soon as they are posted on the website. It is your duty to frequently review the Terms for any modifications.
Your continued use of TAF after these terms have changed will be interpreted as your acceptance of those changes and your agreement to be bound by its terms and conditions.
Additionally, we retain the right to: (1) alter, suspend, or terminate TAF, or any part of Powerup, for any reason; (2) alter Powerup, or any part of TAF, and any applicable policies or terms; and (3) interrupt TAF, or any part of TAF, as needed to carry out routine or non-routine maintenance, error correction, or other changes.
Applicable Law and Dispute Resolution
Applicable law. Any issue that is not agreed upon in these Terms will be governed by English law.
Dispute resolution. The parties will endeavor to resolve all disputes, controversies, and claims that may arise in connection with the execution, termination, or invalidation of these Terms by negotiations. The party which has any claims and / or disagreements shall send a message to the other party indicating the claims and / or disagreements that have arisen. If nevertheless a disagreement or claim was not solved by negotiations, such dispute shall be resolved in the competent court at the place of registration of us.
Miscellaneous
Titles and interpretation. The clause titles in these Terms are for convenience only and have no legal or contractual effect. The word “including” means “including without limitation”.
Independent contractor. Your relationship to us is that of an independent contractor, and neither party is an agent or partner of the other.
